If Røkke and the other owners of the Johan Sverdrup field is not satisfied with the Ministry’s decision to own distribution, they can sue the state, says professor.
There is no agreement on division of ownership between the five companies behind Johan Sverdrup, reports Dagens Næringsliv (DN).
Kjell Inge Rokke is a major shareholder in one of the five companies, the oil company Det Norwegian . They chose not to sign the ownership agreement with the other four companies because they believe their license in the western part is worth more than the license in the east. Now the battle for oil values end in court.
– If a party is dissatisfied with the decision of the Ministry, the company may appeal the decision to the King in Council. If an appeal is not successful there, the company can sue the state to get known the decision invalid, says Professor Ernst Nordtveit in petroleum law at the University of Bergen to DN.
The other four owner companies signed the agreement on distribution of shareholdings. Legally there is nothing to indicate that the Ministry must give decisive weight to the majority attitude, Nordtveit.
