– Impossible to reach
“It was after Spetalen vision clear that the pier was not legally approved. This is also stated in retrospect. Despite this, however, believed first municipality and then Fylkesmannen that pier had to be considered legally approved. It is by subsequent reversal of the decision and legality confirmed that the administration’s original legal standpoint was untenable and that it was regarded as a serious mistake, “writes Øystein Stray Spetalen lawyer Børge Krogsrud law firm Haavind in a letter to the County.
Spetalen would not comment on the claim, but it is mainly related to legal assistance, showing the attached timesheets.
– Scissor Cost requirement we have not yet taken a position, says director Per Arne Andreassen in the County of Vestfold .
– The road to get here has been long in both time and administrative procedures, and it would have been impossible to reach without legal assistance, says partner Børge Krogsrud Haavind.
Considering retrial
Straight dispute Øystein Stray Spetalen traveled towards Fon and Ministry of Local Government and Regional Development was completed last week when the Supreme Court rejected Spetalen appeal.
Spetalen won last year fall forward with their claim that the decision of the County of Vestfold from 2012 was invalid, and this decision was then overturned and a new decision stipulates that brew length must be reduced. But billionaire was not heard with their requirement for a declaratory judgment that Carl Chistian Fons brew is not approved beyond a length of about 20 meters and five outliers north.
– Fon starting to get tired of him not get to have the pier he had on his property since 1998 in peace. It is strange that the government follow this up now in hindsight, but my client is fit and will possibly consider bringing a new decision to court, says lawyer Ole Petter Breistøl.
