– I said “bullshit” – they try to point at me, but it does not happen. So I said, well, so it started, and so ended there.

The words fell in a telephone conversation between the two former Yara peaks Kendrick Wallace and Daneil Clauw, which was recorded court under Yara case in the Oslo District Court Wednesday. The conversation took place right after Wallace had released from custody in Paris 12th May 2012.

The two are joined by former Executive Director Tor Holba and former CEO Thorleif Enger charged gross corruption by having paid bribes to an oil minister’s son in Libya. All except Holba is also accused of a similar relationship in India (see fact box).

Wallace was arrested by French police, interrogated with Økokrim observer and released after 48 hours. Also Clauw had been arrested and interrogated, and Økokrim received permission to wiretap their phones after they were released.

Changed explanation

According to Økokrim was Wallace who signed both the two disputed agreements on behalf of Yara. But in two phone calls that were played for the court, said Wallace clear that there were several top executives who knew of the contested consultancy agreements, and that he acted on his own initiative.

The same information gave Wallace questioning. Shortly after the interrogation in Paris, Økokrim charges also against Tor Holba, Halgeir Storvik, Enger.

In Oslo District Court Wallace however changed explanation, and he says now is not sure who the senior management known to the agreements, and that after having gone through the documentation from Økokrim has found that some of what he said during the first interrogation in Paris, was “completely wrong.”

– I think what I called remembered, was driven by his (Holba, ed.’s note.) was project manager and that I normally reports to project manager. But I have not so much confidence in my memory on this, and when I do not find support for the documentation, I will not under oath here today accuse anyone else in the lead, he said during interrogation the prosecutor.

During the playback calls leaves, however, he is not much doubt that he believes Holba knew about the agreements. The talks leaves no impression that Wallace was unsure who the management who knew what about the case.

He also said that he was sorry that Hallgeir Storvik was charged with, and that this was no result of information he had provided. Storvik is not prosecuted bench in the case.

Enger also claims that he was not aware of the agreement before he was notified of the Tor Holba. His lawyer, Ellen Holager Andenæs says she will not comment on an ongoing basis information appearing in court.

Wallace also admitted that he first day of questioning refused to talk about the controversial Libyan consultant, but that he changed his view after it was read to him how including Tor Holba had explained about the case.
